Terms of Service

These Terms of Service ("Terms") govern your access to and use of EMA AI ("Service") operated by the EMA AI team based in Austria. By using the Service you agree to these Terms in full.

1. The Service

EMA AI provides a multi-tenant SaaS platform for embedding AI assistants on third-party websites. You ("Customer") agree to use the Service only for lawful purposes and in compliance with your local regulations.

2. Subscription & Billing

Paid plans are billed through Stripe in EUR. VAT for EU customers is applied automatically at checkout. Unused credits roll over for 30 days from each billing event.

3. Acceptable use

You must not use the Service to host content that is unlawful, hateful, sexual involving minors, or that infringes third-party intellectual property. We may suspend accounts that violate these limits.

4. AI output disclaimer

AI assistants generate text on the basis of your business context. EMA AI does not guarantee accuracy of every reply. You remain responsible for the content that visitors see on your website.

5. Data & privacy

Personal data is processed under our Privacy Policy. We are GDPR-compliant and store data only in the EU.

6. Termination

Either party may terminate the agreement at any time. Upon termination access to the Service is revoked; data may be exported on request within 30 days.

7. Liability

To the extent permitted by Austrian law, EMA AI's liability is limited to the amount you paid in the last 12 months.

8. Changes

We may update these Terms; notice is sent to the account email at least 14 days before changes take effect.
